Terms and Conditions
These Terms and Conditions apply to all purchases from our web site. Please read them carefully before placing an order.
Acceptance of your order
We must receive payment of the price of the items and the delivery charges (if applicable) before we can accept your order. We reserve the right to restrict the number of items you may order and to refuse any order. If you have provided us with your email address you will receive an email from us confirming that we have received your order. This email is sent automatically and does not mean that we have accepted your order. We will notify acceptance of your order by sending an email to you stating that your order has been accepted and despatched. Otherwise, our acceptance of your order takes place upon delivery of the items. Only when we have accepted your order is a binding contract created between us.
Currency
All sales are in Australian dollars. All sales to Australian customers will include GST. Purchasers outside Australia may pay by credit card only. The exchange rate will be calculated by the credit card bank and will appear on your statement in your local currency. If you want to know the approximate cost in your own currency, just click on the select currency link (top left) and choose your country from the pull-down menu. When you add an item to the shopping cart, both currencies will display in the dialog box.
Payment Options
We accept VISA, MASTERCARD, AMERICAN EXPRESS, Bartercard, Cheque (subject to clearance), Pick Up and Pay, Postal Orders, Money Orders or COD. COD payments will be subject to a COD charge.
If paying by cheque, money order or postal transfer, please print the confirmation email to send with your payment.
Shipping
Shipping costs depend on the item(s) purchased.
1 to 2 items up to 3kgs (Australia only) $12 overnight
Bulky items up to 3kgs (Australia only) $15 overnight
If you require the item to be sent to a location outside Australia, then there will be additional charges. When you use the checkout function on our website, an estimated cost for shipping and handling will be included. The actual shipping costs will be advised as soon as we process and confirm your order.
Shipping Delays
Orders are generally shipped within three to four working days if the item is in stock. If the item is NOT in stock, you will be advised by email and an alternative item will be offered to you.
We do NOT take any responsibility for late shipment(s). However you will be notified via email when your shipment has left for delivery.
Sales Tax
Prices listed include a charge for GST. Orders for delivery outside Australia will NOT include the GST charge.
Availability
All orders are subject to availability of items. If we are unable to deliver items ordered by you we will notify you (where possible) and, if we have received the price and the delivery charges of the unavailable items, we will refund them to you within 30 days of your order unless you agree to a longer period.
Refunds Policy
Please choose carefully as refunds will not be given if you simply change your mind.
Final decisions on refunds, exchanges and credit notes are left to the discretion of the manager.
Any items returned to us for a refund or exchange should be returned to us in their original condition and carefully packaged.
When making a refund, we will credit our delivery charges if the reason for return is because of our error.
Returns Policy
Elegance Plus will exchange your purchases if the fabric or craftsmanship is faulty or the size is incorrect. Any return must be within seven days of delivery and not worn or laundered. Colours shown in this catalogue are intended as a guide only and may not be identical to items ordered.
If items we deliver to you are not as ordered or are faulty or of incorrect quantity you should contact us within 7 days of delivery. We will replace the incorrect or faulty items or make good the shortfall in quantity or, at our option, credit the price and delivery charges of those items to you.
To return any items contact us by email or phone or take the items to our store. You must provide us with the original invoice, despatch note or other proof of purchase.
If you do not receive items ordered you should notify us within 21 days of the date of your order. We will deliver the items ordered or, at our option, credit the price and delivery charges of the non-delivered items to you, or if we have not accepted your order and have been unable to contact you, we will notify you of the reason for non-acceptance.
If the items are returned because of a change of mind, no refund will be given.
Governing Law
Elegance Plus reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions. The laws of the State of Western Australia, Australia, shall govern these terms and conditions and use of the website and the user submits to the jurisdiction of the state of Western Australia with respect to any dispute relating to use of the website or content.
